Terms of Use
Website Terms of Use & SMS Messaging Terms
1. Acceptance of These Terms
These Website Terms of Use and SMS Messaging Terms (“Terms”) govern your access to and use of the SelecSource website, online forms, candidate and client resources, and related digital services (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
If you submit information on behalf of a business or other organization, you represent that you are authorized to do so.
2. Staffing Services Are Governed Separately
Any staffing, recruiting, placement, payroll, workforce, consulting, or other professional services provided by SelecSource are governed by separate written agreements, service orders, assignment documents, or other applicable terms. These Website Terms do not by themselves establish rates, placement fees, candidate ownership, conversion fees, guarantees, payment obligations, or other commercial staffing terms.
3. Job Information and Applications
Job postings and other opportunities displayed on the Site are provided for general informational purposes and may be changed, filled, placed on hold, or removed at any time. Submission of an application, resume, profile, or other information does not guarantee an interview, assignment, placement, offer of employment, or continued employment.
You are responsible for providing accurate, current, and complete information. SelecSource may verify information you provide where permitted by law and as appropriate to the staffing or recruiting process.
4. SMS / Text Messaging Terms
The text-message program described in this Section 4 is operated by SelecSource LLC. This Section 4 is part of these Terms and should be read together with our Privacy Policy at https://www.selecsource.com/privacy/ and may be reached directly at https://www.selecsource.com/terms/.
4.1 Program Description
SelecSource may offer SMS or text messaging programs to communicate with candidates, employees, applicants, clients, prospects, and other individuals who have provided a mobile number and appropriate consent. Depending on the relationship and the consent provided, messages may include job opportunities, application updates, interview reminders, assignment information, onboarding or scheduling communications, time-sensitive workforce updates, service notifications, customer support messages, and promotional or marketing communications.
4.2 Consent to Receive Messages
When you affirmatively opt in to receive text messages from SelecSource through a website form, checkbox, keyword, written consent, or other authorized method, you consent to receive text messages at the mobile number you provide. Depending on the program and your consent, messages may be sent using automated technology.
Consent to receive job alerts and assignment text messages is not a condition of applying for a job, being considered for employment, accepting an assignment, purchasing services, or otherwise doing business with SelecSource.
Your consent applies only to the SelecSource Job Alerts, and any promotional or marketing texts require a separate, optional consent. See Section 4.10 for exactly how you opt in.
4.3 Message Frequency and Charges
Message frequency will vary based on your relationship with SelecSource, your activity, and the messaging program in which you participate. Message and data rates may apply according to your wireless plan. SelecSource does not charge a separate fee for text messages, but your wireless carrier may.
Message and data rates may apply. Check with your wireless carrier for details.
4.4 Opting Out / Revoking Consent
You may opt out of text messages at any time by replying STOP to a message. SelecSource may also recognize other reasonable requests that clearly communicate your desire to stop receiving text messages. After an opt-out request, you may receive a single confirmation message. You will not receive further messages from the applicable messaging program unless you later provide consent again, except where a message is legally permitted or necessary to address a request you initiated.
Reply STOP to any text message to cancel. If you opted out of one SelecSource text program, you may still receive texts from a different program you separately agreed to; tell us if you want all texts to stop. To start again later, reply START or sign up again.
If you are currently on assignment, stopping texts does not end your assignment. You will still need to receive schedule and assignment information another way, such as by phone or email, and SelecSource will tell you how.
4.5 Help
For assistance with text messages, reply HELP or contact SelecSource at 678.990.1109 and/or using the contact information provided on the Site.
4.6 Mobile Number Responsibility
By providing a mobile number, you represent that you are the subscriber or customary user of that number and are authorized to consent to receive messages at that number. If your mobile number changes or is reassigned, you agree to notify SelecSource or update your information so messages are not sent to another person.
4.7 Delivery and Carrier Disclaimer
Text message delivery is subject to effective transmission by your wireless carrier and is not guaranteed. Wireless carriers are not responsible for delayed or undelivered messages. Availability of text messaging may vary by carrier, device, and location.
4.8 Privacy and SMS Data
Information collected through SMS interactions may include your mobile number, message content, consent and opt-out records, delivery information, and related metadata. SelecSource may use service providers to facilitate messaging. SMS-related information will be handled in accordance with SelecSource’s Privacy Policy (https://www.selecsource.com/privacy/) and applicable law. SelecSource does not sell or share SMS consent information for unrelated third-party marketing without appropriate authorization.
4.9 Types of Messages You Will Receive
If you opt in to SelecSource Job Alerts, we will text you about your job search and any assignment with us, such as:
- job openings and assignment offers that match what you told us you are looking for;
- application and interview updates, and reminders to complete onboarding steps (for example, paperwork, drug screen, or orientation);
- shift, start-time, location, and schedule information, including last-minute changes;
- check-ins during your assignment, timesheet or pay-related reminders, and requests to confirm your availability; and
- replies to questions you text us.
4.10 How You Opt In
You are signed up for SelecSource Job Alerts only if you take one of these actions yourself:
- Online form: enter your mobile number on a SelecSource application, contact, or job-alert form and check the box agreeing to receive texts from SelecSource Job Alerts. The box is never pre-checked.
- In person or on paper: sign a written application or onboarding form containing the same text-message consent language, or tell a SelecSource recruiter you want texts.
4.11 Changes to the Text Messaging Program
We may update this Section 4 from time to time under Section 13. If a change materially affects your consent, we will ask for your consent again where the law requires it.
5. Email and Other Electronic Communications
If you provide an email address or other contact information, SelecSource may communicate with you regarding your inquiry, application, assignment, account, services, or other relationship with SelecSource. Marketing communications should include any opt-out mechanism required by applicable law.
6. Privacy
Use of personal information collected through the Site should be governed by a separate Privacy Policy that explains SelecSource’s data collection, use, disclosure, retention, security practices, cookies and analytics practices, and applicable privacy rights. These Terms are not intended to replace that Privacy Policy.
SelecSource’s Privacy Policy is available at https://www.selecsource.com/privacy/.
7. Permitted Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You may not interfere with the operation or security of the Site; attempt to gain unauthorized access to systems or data; introduce malicious code; use automated means to scrape or harvest information except as expressly authorized; impersonate another person or entity; submit false or misleading information; or use the Site in a manner that violates applicable law or the rights of others.
8. Intellectual Property
Unless otherwise indicated, the Site and its content, including text, graphics, logos, design elements, software, and other materials, are owned by or licensed to SelecSource and are protected by applicable intellectual property laws. You may view and use Site content for your own lawful purposes, but you may not reproduce, distribute, modify, sell, license, or create derivative works from Site content without permission, except as permitted by law.
9. Third-Party Websites and Services
The Site may contain links to third-party websites, job boards, social platforms, applicant tracking systems, payment or scheduling tools, or other services that SelecSource does not control. SelecSource is not responsible for the content, availability, security, privacy practices, or terms of third-party services. Your use of a third-party service is subject to that provider’s terms and policies.
10. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. SELECSOURCE MAKES NO WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT INFORMATION ON THE SITE WILL ALWAYS BE COMPLETE, CURRENT, OR ACCURATE. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SELECSOURCE AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO USE OF, OR INABILITY TO USE, THE SITE.
12. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless SelecSource and its affiliates from claims, losses, liabilities, and expenses arising from your unlawful misuse of the Site, your violation of these Terms, or your infringement of another person’s rights.
13. Changes to These Terms
SelecSource may update these Terms from time to time. The revised Terms will be posted on the Site with an updated effective date. Where required by law, SelecSource will provide additional notice or obtain renewed consent before a change becomes effective.
14. Governing Law
These Terms are intended to be governed by the laws of the State of Georgia, without regard to conflict-of-law principles, unless applicable law requires otherwise.
